If your situation involves complex structures (e.g. multiple companies or trusts), we’ll assess your draft first and let you know upfront if any additional work or cost is required. No surprises.

What does the Fixed Price Legal Review cover and what doesn’t it include?

RP Emery’s Fixed Price legal review includes independent advice for both parties, as required by law. This covers the lawyers advising you of the effect of signing the agreement on your rights, and the advantages and disadvantages of entering into the agreement.

It does not include negotiation, re-drafting, or acting for one party against the other. Our lawyers specialise in this process and work to ensure your agreement meets legal requirements without unnecessary complications.

Is this cheaper than using a traditional lawyer?

Yes it offers significant savings. A typical prenup through a traditional lawyer can cost $3,000 to $5,000 per person. Our system is more affordable because you complete the agreement yourself using our step-by-step template, instead of paying a lawyer to collect and input your information. Then, our lawyers review the agreement and provide the required advice for both parties for a fixed fee.

Is it hard to complete the prenup agreement template?

Not at all. As long as you’re comfortable with basic computer tasks like opening a Word document and sending an email, you’ll be fine.

You’ll receive a lawyer-drafted agreement in Microsoft Word format. The kit includes step-by-step instructions, and one of the things you’ll be asked to do is complete a statement of assets and liabilities.

An Assets and Liabilities statement is similar to what you’d fill out when applying for a home loan – a simple list of what you own (like property, vehicles, savings) and what you owe (like mortgages, loans, or credit cards). It doesn’t need to be complicated, and our guide walks you through it.

Some basic computer skills are required. If you’re not confident or don’t have access to Microsoft Word then this kit may not be the right fit, as we’re not able to provide technical support for general computer use. But if you can open and edit a Word file, save it, and email it, then you have everything you need.

Do both of us need to get legal advice?

Yes. Under Australian law, a prenuptial agreement (Binding Financial Agreement) only becomes binding if each person receives independent legal advice.

That’s why we offer legal review for both parties as part of one fixed-price service; to keep things simple, compliant, and cost-effective.

Without this option, you’d need to find two separate independent family lawyers, make appointments, send them the document, and negotiate pricing. That often leads to open-ended legal fees or lawyers who want to re-draft the agreement entirely, creating unnecessary stress and expense.
